9. Release, Indemnification and Hold Harmless

The training in the course(s) offered by D.R.A.W. School are firearms related. Firearms training is inherently dangerous. The Law Enforcement D.R.A.W. School Firearms Training courses will instruct you throughout the program to practice safe firearms handling, to make sure your firearm is always SAFE and CLEAR, and that you should NEVER conduct or participate in any training segment contained in this course without having a BarrelBlok dry-fire training aid properly inserted into your firearm during instructional and practical dry-fire exercises. Ensuring that your firearm is safe and you are handling it in a safe manner at all time is your sole responsibility. By continuing on to ANY portion of this firearms training course, you agree to, and certify, the following:

You, the student, agree to indemnify, hold harmless and defend Fenix Law Enforcement Training LLC, and any of its owners, employees, instructors, directors, officers, subsidiaries, agents or affiliates (hereinafter "Fenix"), from any and all fault, liabilities, costs, expenses, claims, demands or lawsuits arising out of, related to or connected with, but not limited to: firearms instruction, firearms training, firearms training techniques, dry-fire firearms training, the discharge of firearms related to any aspect of this course, the discharge of a firearm not related to this course, including while on-duty or off-duty, the course of instruction, your participation in the course of instruction, curriculum, current or future law enforcement work, the range, buildings, land, landowners and premises used for taking this course (hereinafter the "Premises"); your presence on or use of said Premises; and any and all acts or omissions of you, the student. And should any such claim, demand or lawsuit arise or be asserted in any way whatsoever related thereto, whether arising under the laws of the United States or of any State, or under any theory of law or equity, you, the student, fully agree to indemnify, hold harmless and defend Fenix from any and all costs, expenses or liability including, but not limited to, the cost of any settlement or judgment made or rendered against Fenix, whether individually, jointly, or in so lido with you, the student, together with all costs of court and other costs or expenses incurred in connection with any such claim, demand or lawsuit, including attorney's fees.

You, the student, furthermore waive for yourself and your executors, administrators, assignees or heirs, any and all rights and claims for damages, losses, demands and any other actions whatsoever, which you may have or which may arise against Fenix, (including, but not limited to any and all injuries, damages or illnesses suffered by you, the student and/or your property), which may, in any way whatsoever, arise out of, be related to or be connected with: the course of instruction; the Premises, the student's property and, the discharge of firearms. Fenix shall not be liable for you, the student, and/or on behalf of your executors, administrators, assignees or heirs. You, the student, hereby expressly release Fenix from any and all such claims.

You, the student, hereby expressly assume the risk of taking part in any and all activities of this course, on the Premise of your choice, which include, but are not limited to, instruction in firearms training, dry-fire firearms training, the use of firearms, the discharge of firearms and the firing of live ammunition. You, the student, furthermore, hereby acknowledge and agree that you have read, understand and will at all times abide by all Fenix training safety rules and procedures as directed in this online training course.

By enrolling this online firearms training course, per the Terms of Use, whether you participate in whole or in part, you agree that Release, Waiver, Indemnification Hold Harmless and Assumption of Risk instrument in its electronic format legally binds you, the student, and your executors, administrators, assignees or heirs.
